Rejected the request of parole skilled by an intern who suffers Lymphoma of nonHodgkin because the degree in which to the time of the request it is being developed the disease prevents to consider it as serious disease.
The medical report refers that the disease is being dealt with chemotherapy and that is being responded to the treatment favorably; also that the patient is independent for all the activities of his daily life being able to be the carried out treatment in center penitentiary, as one has come realising to date. The report is restrictive when informing that contraindications as far as in center penitentiary permanence do not exist.
It also evaluates the Court that does not exist in the intern a prognosis of low danger because taking care of the state in which is the disease, its criminal capacity is not altered.
The intern is fulfilling a sentence of 15 years of prison by a crime of sexual aggression, with the aggravating one of recidivism because another sentence of 30 years by a violation crime consists and the date of definitive freedom appears very distant, in 2022; in addition he does not consist that he has followed a program or treatment related to the committed crime, and has not fulfilled his civil responsibility towards the victim, circumstances all of them that advise that the due guarantees in altars stay to the protection of the society.
